Terms of Service
Effective October 29, 2026
1. About these terms
1.1 Who we are. GraphWorks, GraphWorks Access and GraphWorks EQ are run by Headphones Inc., doing business as Headphones.com ("Headphones.com", "we", "us", "our"), 111 SW 5th Ave, Suite 3150, Portland, Oregon 97204, USA.
1.2 What these terms cover. These terms govern your use of:
- the GraphWorks website at graph.headphones.com, including its measurement library and visualizer;
- GraphWorks Access, the subscription that unlocks them (Section 4); and
- your use of GraphWorks Access with GraphWorks EQ, the equalizer app for Windows and macOS (Section 5).
Together, these are the "Service".
1.3 Your agreement. By creating a GraphWorks account or buying GraphWorks Access, you agree to these terms. Our Privacy Notice (Section 8) explains how we handle your personal information. If you do not agree, do not use the Service.
1.4 Other Headphones.com terms. Purchases on headphones.com are covered by the Headphones.com Terms of Service. If you get GraphWorks Access through a Sonic+ membership, your membership fees, renewal and cancellation are covered by the Sonic+ Membership Program terms in Section 22 of those terms, and your use of GraphWorks is covered by these terms. Where the two conflict on anything specific to GraphWorks, these terms apply.
1.5 Arbitration notice. SECTION 14 REQUIRES MOST DISPUTES TO BE RESOLVED BY BINDING INDIVIDUAL ARBITRATION AND WAIVES CLASS ACTIONS AND JURY TRIALS. YOU CAN OPT OUT WITHIN 30 DAYS AS DESCRIBED IN SECTION 14.5.
2. Accounts and eligibility
2.1 Age. You must be at least 18, or the age of majority where you live if that is higher, to create an account or buy GraphWorks Access.
2.2 Your account. Give us accurate information and keep it up to date. Keep your password private. You are responsible for what happens under your account, so tell us at info@headphones.com if you think someone else has used it.
2.3 One person per account. An account is for one person. Do not share your sign-in, and do not sell, transfer or lend your account or your access.
2.4 Linked accounts. To use GraphWorks Access through Sonic+, you link your GraphWorks account to your Headphones.com customer account. To use it through a YouTube channel membership, you link your Discord account (Section 4.10). We check your membership when you link and regularly after that.
2.5 Deleting your account. You can delete your account in Settings. If a GraphWorks Access subscription can still charge you, cancel it first. Deleting your account does not refund time already paid for, and GraphWorks EQ stops working on your computers at their next licence check, within 7 days.
3. The Service
3.1 What GraphWorks is. GraphWorks publishes frequency response measurements of headphones and earphones, with tools to compare them, view them against preference targets, and build EQ settings. Some parts of GraphWorks may be open without an account. GraphWorks Access unlocks the measurement library, the visualizer and GraphWorks EQ. You hold GraphWorks Access through a paid subscription (Section 4), an active Sonic+ membership (Section 4.9), or a YouTube channel membership of The Headphone Show that includes it (Section 4.10).
3.2 Changes to the Service. We add, update and remove measurements, targets and features over time, and we may change or stop offering any part of the Service. If we stop offering GraphWorks Access altogether, we will refund the unused part of your current paid period. If you live in the EU, the EEA or the UK and we change GraphWorks Access in a way that makes it clearly worse for you, we will tell you in advance, and you can end your subscription free of charge within 30 days of the change and get back the unused part of your current paid period.
3.3 Availability. We work to keep the Service running, but we do not promise it will always be available. Maintenance, outages, and the services we rely on, such as hosting and payment providers, can interrupt it.
3.4 System requirements. GraphWorks EQ currently runs on Windows 10 or later (x64) and on Mac computers with Apple silicon running macOS 14 or later. Requirements may change with updates and are listed on the download page.
4. GraphWorks Access subscriptions
4.1 Price and payment. GraphWorks Access costs US$4.99 a month. You pay by card through Stripe, or with PayPal. Each processes your payment under its own terms, and we never receive or store your full card number. If you pay by card from outside the United States, checkout may show the price in your local currency, converted at Stripe's exchange rate plus a currency conversion fee, usually 2 to 4%. If you pay with PayPal, PayPal charges the price in US dollars and, if your PayPal account uses another currency, converts it at PayPal's exchange rate. The amount shown at checkout is what you pay for your first month, and later months can differ slightly as exchange rates move.
4.2 Taxes. The price shown at checkout is the total you pay. We do not add sales tax, VAT or GST to it today. If that changes, any tax will be shown at checkout before you pay, and we will tell you before it applies to a renewal.
4.3 Automatic renewal. YOUR SUBSCRIPTION RENEWS AUTOMATICALLY EVERY MONTH. AT THE START OF EACH MONTHLY BILLING PERIOD, WE OR OUR PAYMENT PROVIDER WILL CHARGE YOUR PAYMENT METHOD THE CURRENT MONTHLY PRICE UNTIL YOU CANCEL. Your billing period starts on the day you subscribe.
4.4 Cancelling. You can cancel at any time in Settings on GraphWorks: choose Cancel subscription and confirm on the screen that opens. If you pay with PayPal, you can also cancel in your PayPal account. Cancel before your renewal date, shown in Settings, to avoid the next charge. We email you to confirm. Your access continues until the end of the month you have paid for, then ends.
4.5 Refunds. We do not give refunds or credits, including for partial months, except under Section 4.6 (withdrawal in the EU, the EEA and the UK), Section 3.2 (if we stop offering GraphWorks Access), Section 13.2 (if we end your access for a reason other than a breach of these terms), if we charged you in error, or where the law requires. If we refund your latest payment in full, for any reason, your subscription ends and your access stops at once (GraphWorks EQ stops at its next licence check, within 7 days). If you think we charged you in error, email info@headphones.com within 60 days of the charge.
4.6 Withdrawal in the EU, the EEA and the UK. If you live in the European Union, the European Economic Area or the United Kingdom, you can withdraw from a GraphWorks Access subscription within 14 days of the day it starts, without giving a reason, and get a full refund of your first payment. The 14 days do not restart at each renewal. To withdraw, email info@headphones.com within those 14 days saying that you want to withdraw, or send us the form below. If Withdraw from contract appears in Settings, you can use that instead. Your subscription ends as soon as you withdraw, your access to the website stops, and GraphWorks EQ stops at its next licence check, within 7 days. We refund your payment the way you paid, to your card or through PayPal, straight away, and in any case within 14 days. A card refund can take your bank 5 to 10 business days to show; PayPal usually shows a refund within a few days. Nothing in this section limits rights your local law gives you.
Model withdrawal form. Fill in and send this form only if you want to withdraw from the contract.
- To: Headphones Inc., 111 SW 5th Ave, Suite 3150, Portland, Oregon 97204, USA, info@headphones.com
- I hereby give notice that I withdraw from my contract for the provision of the following service: GraphWorks Access
- Ordered on:
- Name:
- Address:
- Email address of your GraphWorks account:
- Signature (only if you send this form on paper):
- Date:
4.7 Failed payments. If a renewal payment by card fails, we email you and try your payment method again for up to two weeks. Your access continues while we try, and you can update your card in Settings under Manage billing. If the payment still fails, your subscription is cancelled and your access ends. If a renewal payment by PayPal fails, PayPal tells you and tries twice more over the next 10 days. Your access continues while it tries, and you can update how you pay in your PayPal account. If the payment still fails, PayPal stops the subscription and your access ends.
4.8 Price changes. We may change the price of GraphWorks Access. We will email you at least 30 days before a new price applies to your subscription, and it takes effect at your first renewal after that notice. If you do not want to pay the new price, cancel before that renewal.
4.9 Sonic+ members. GraphWorks Access is included with every Sonic+ membership tier at no extra charge, so you do not need a separate subscription. Your access follows your membership, including through the end of the paid period after you cancel. Sonic+ billing is covered by the Sonic+ Membership Program terms. Linking Sonic+ does not cancel a GraphWorks Access subscription you already pay for; cancel it in Settings if you no longer need it.
4.10 YouTube channel members. GraphWorks Access is included with the channel membership levels of The Headphone Show on YouTube that list it as a membership perk. To use it, join the Headphones.com Discord server, connect your YouTube account to Discord, and link your Discord account in GraphWorks Settings. We check your membership when you link and regularly after that, and your access ends when your membership does. YouTube sells and bills channel memberships under its own terms, so cancellations and refunds go through YouTube. Linking it does not cancel a GraphWorks Access subscription you already pay for; cancel it in Settings if you no longer need it.
4.11 Payment disputes. If you have a problem with a charge, please contact us first at info@headphones.com. If you dispute a charge with your bank, your card issuer or PayPal, we may pause your access while the dispute is open, and end your subscription if the payment is returned to you.
5. GraphWorks EQ
5.1 The app's licence. GraphWorks EQ, the equalizer app for Windows and macOS, and its audio driver (together, "the Software") are licensed to you by us under the GraphWorks EQ licence terms, which govern how you may install and use it.
5.2 What GraphWorks Access adds. The equalizer's processing works only while you hold GraphWorks Access. Without it, the Software passes audio through unchanged.
5.3 Computers and licence checks. Sign in from the application to activate a computer. You can have up to three active computers at a time and can remove one in Settings. A computer that has not checked in for 90 days no longer counts toward your limit. The Software confirms your access with our servers about once every 7 days. If it cannot, because the computer has been offline too long or your access has ended, the Software passes audio through unchanged until your access is confirmed again.
6. Acceptable use
6.1 Use of measurements. The measurements, graphs, targets and other data in GraphWorks ("GraphWorks Content") are licensed to you for your own use while you have access.
6.2 Sharing graphs. You may share images you export from the visualizer, the share and embed links GraphWorks creates, and screenshots of GraphWorks, in reviews, forum posts, videos, websites and social media, as long as the GraphWorks name and any watermark stay visible and you credit graph.headphones.com. Do not share raw measurement data.
6.3 What you may not do. You may not:
- scrape, crawl or bulk download GraphWorks, or access it with bots or other automated tools;
- publish, sell or redistribute GraphWorks Content as a dataset, or copy it into another database, graphing tool or product;
- use GraphWorks Content to train or tune machine learning or artificial intelligence models;
- get around access controls, rate limits or the subscription requirement;
- interfere with the security or operation of the Service, upload malicious code, or probe for vulnerabilities (if you find one, please report it to info@headphones.com);
- alter a graph and present it as a GraphWorks result; or
- use the Service unlawfully or in a way that infringes anyone's rights.
7. Ownership, trademarks and feedback
7.1 Our rights. The Service, the Software, GraphWorks Content, and the site's design, text and code are owned by Headphones Inc. or its licensors and are protected by copyright, database and other laws. You get only the rights these terms expressly give you.
7.2 Trademarks. GraphWorks, GraphWorks EQ, GraphWorks Access, Sonic+ and Headphones.com are trademarks of Headphones Inc. Names of headphones and other products belong to their owners. A product's appearance in GraphWorks does not mean its maker endorses us, or that we endorse it.
7.3 Feedback. If you send us ideas, suggestions or bug reports, we may use them without any obligation or payment to you.
7.4 Your settings. EQ presets, settings and anything else you create or upload in the Service remain yours. You give us permission to store, process and display them as needed to run the Service for you. You are responsible for what you upload and confirm you have the right to upload it.
7.5 Copyright complaints. If you believe something in GraphWorks infringes your copyright, email info@headphones.com with the information required by 17 U.S.C. § 512(c)(3).
8. Privacy
How we collect, use, share and keep your personal information is described in the GraphWorks Privacy Notice. Purchases on headphones.com are covered by the Headphones.com Privacy Policy.
9. Hearing safety and measurements
9.1 Protect your hearing. GraphWorks EQ can raise the level of some frequencies, and its tone generator plays sine tones and noise. Loud sound can permanently damage your hearing. Turn the volume down before you change filters or presets or use the tone generator, then raise it gradually.
9.2 Protect your equipment. High levels, large boosts in the bass or treble, and test tones played loudly can damage headphones, speakers and amplifiers. You are responsible for the levels you play.
9.3 Measurements are a guide. Each measurement comes from a specific unit on a specific rig, ear simulator and fitting method. Your headphones may differ from the unit we measured, and fit, seal, ear pads and the shape of your ears all change what you hear. Preference targets and bounds reflect research averages, not your own taste or hearing. An EQ result is a starting point, not a promise of how your headphones will sound.
9.4 Not medical advice. The Service is not a hearing test, a hearing aid or a medical device, and nothing in it is medical advice. If you have concerns about your hearing, see a qualified professional.
10. Disclaimer of warranties
TO THE FULLEST EXTENT THE LAW ALLOWS, THE SERVICE, THE SOFTWARE AND GRAPHWORKS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE OR THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, THAT MEASUREMENTS ARE ACCURATE OR COMPLETE, OR THAT THE SOFTWARE WILL WORK WITH YOUR COMPUTER, AUDIO DEVICES OR OTHER SOFTWARE. THE DRIVER RUNS INSIDE THE WINDOWS KERNEL OR THE MACOS AUDIO SERVER, AND THIS SECTION APPLIES TO IT IN FULL, INCLUDING ANY SYSTEM INSTABILITY, DATA LOSS OR LOSS OF AUDIO. Some jurisdictions do not allow these exclusions, so some of them may not apply to you.
11. Limitation of liability
11.1 Excluded damages. TO THE FULLEST EXTENT THE LAW ALLOWS, NEITHER HEADPHONES INC., ITS PARENT PREMIUM SOUND INC., NOR THEIR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, LICENSORS OR SUPPLIERS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE OR THE SOFTWARE, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, EVEN IF WE WERE TOLD THEY WERE POSSIBLE.
11.2 Cap. TO THE FULLEST EXTENT THE LAW ALLOWS, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE OR THE SOFTWARE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR GRAPHWORKS ACCESS IN THE 12 MONTHS BEFORE THE EVENT THAT GAVE RISE TO THE CLAIM AND (B) US$50.
11.3 What we do not limit. Nothing in these terms limits liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit. If you are a consumer, you keep any rights your local law gives you that a contract cannot take away.
12. Indemnity
To the extent the law allows, you will defend and indemnify Headphones Inc. and its affiliates, officers, directors, employees and contractors against third-party claims, and the related costs including reasonable legal fees, arising from your breach of these terms, your misuse of the Service, the Software or GraphWorks Content, or your violation of any law or anyone else's rights.
13. Suspension and termination
13.1 By you. You can stop at any time: cancel your subscription (Section 4.4), uninstall the Software, and delete your account in Settings.
13.2 By us. We may suspend or end your access, deactivate your computers, or close your account if you seriously or repeatedly break these terms (including Section 6.3), if the law requires it, or to protect the Service, other users or us from fraud or harm. Where reasonable, we will tell you first and give you a chance to fix the problem. If we end your access because you broke these terms, you get no refund. If we end it for any other reason, we will refund the unused part of your current paid period.
13.3 What happens next. If your GraphWorks Access ends but your account stays open, you can keep GraphWorks EQ installed, and it passes audio through unchanged. Sections 6.2, 6.3, 7 and 9 to 17, and any amounts you owe, survive the end of these terms.
14. Disputes and arbitration
14.1 Contact us first. Before starting a claim, email info@headphones.com describing the problem and what you are asking for. We will try to resolve it with you within 60 days.
14.2 Arbitration. Except as Section 14.3 provides, any dispute arising from or relating to these terms, the Service or the Software will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, which also govern how fees are paid. Hearings take place by video or in the county where you live. The arbitrator can award the same individual relief a court could. The Federal Arbitration Act governs this section.
14.3 Exceptions. Either of us may bring an individual claim in small claims court. Either of us may go to court over infringement or misuse of intellectual property, including circumvention of the protections in the Software.
14.4 No class actions. You and we may bring claims only individually, not as a plaintiff or class member in any class, consolidated or representative proceeding. YOU AND WE EACH WAIVE THE RIGHT TO A JURY TRIAL.
14.5 Opting out. You can opt out of arbitration within 30 days of first agreeing to these terms by emailing info@headphones.com with your name, your account email and a statement that you opt out. Opting out does not affect the rest of these terms.
14.6 Courts. If you opt out, or if arbitration does not apply to a dispute, it will be heard in the state or federal courts located in Delaware. If you are a consumer outside the United States, nothing in this section removes your right to bring proceedings in your home courts where your local law gives you that right.
15. Governing law
These terms are governed by the laws of the State of Delaware, without regard to its conflict of law rules, consistent with the Headphones.com Terms of Service. The UN Convention on Contracts for the International Sale of Goods does not apply. If you are a consumer outside the United States, you keep the protection of any mandatory consumer law of the country where you live.
16. Changes to these terms
We may update these terms. For a material change, we will tell you by email or in the Service at least 30 days before it takes effect, unless the change is required by law or covers a new feature, in which case it may take effect sooner. If you keep using the Service after a change takes effect, you accept the updated terms. If you do not accept them, cancel your subscription and stop using the Service. Changes do not apply to disputes we already knew about before the change.
17. General
- Entire agreement. These terms and, for Sonic+ members, the Sonic+ Membership Program terms are the whole agreement between you and us about the Service.
- Severability. If a court or arbitrator finds part of these terms unenforceable, that part is enforced as far as the law allows and the rest stays in effect.
- No waiver. If we do not enforce a right, we have not given it up.
- Assignment. You may not transfer these terms or your account. We may transfer them as part of a merger, acquisition or sale of assets, or to an affiliate.
- Events beyond our control. We are not responsible for delays or failures caused by events outside our reasonable control.
- Notices. We send notices to the email address on your account.
- Language. If we translate these terms, the English version applies.
